UNDISPUTED BOXING GYM
RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS, AND INDEMNITY AGREEMENT
(hereinafter the “Release Agreement”)

BY SIGNING UP, PURCHASING A PRODUCT, OR PARTICIPATING IN ANY ACTIVITY ASSOCIATED WITH UNDISPUTED BOXING GYM, YOU WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR NEGLIGENCE, BREACH OF CONTRACT, OR UNDER OCCUPIERS’ LIABILITY LAW.
PLEASE READ CAREFULLY.

This Release Agreement applies to all current and future participation in boxing, fitness, athletic, instructional, virtual, offsite, and digital activities as defined below, provided by Undisputed Boxing Gym.

TO:
Undisputed Boxing Gym (including all its owners, employees, trainers, coaches, volunteers, independent contractors, subcontractors, officers, directors, representatives, agents, successors, and assigns—hereinafter collectively referred to as the “Releasees”).

ACTIVITIES

In this Release Agreement, the term "Activities" includes, but is not limited to:

Boxing, sparring, and combat training
Strength and conditioning programs
Fitness classes, HIIT, bootcamps, and cardio workouts
Personal training and small group training
Use of gym equipment, locker rooms, washrooms, and parking facilities
Participation in gym-hosted events, community meetups, tournaments, and offsite training
Virtual classes, livestream sessions, digital training programs, PDFs, and other online content
Nutrition consultations, lifestyle coaching, and participation in challenges
All movement through Undisputed Boxing Gym's premises or affiliated locations

This agreement applies regardless of whether the Activities take place on the premises, at an event location, outdoors, or online.

ASSUMPTION OF RISKS

I understand that participation in Activities involves known and unknown risks, dangers, and hazards, which may include but are not limited to:

Physical contact with coaches, participants, and equipment
Risk of injury including bruises, strains, sprains, concussions, cuts, or broken bones
Serious injury or illness including cardiovascular complications, overexertion, dehydration, or infection
Equipment failure or improper use
Slip, trip, and fall incidents
Exposure to contagious illnesses, including viruses, despite health and safety precautions
Injury during participation in unsupervised or remote training programs

I acknowledge that the Releasees may fail to foresee or warn against all possible risks. I freely and fully accept and assume all such risks, dangers, and hazards, and the possibility of personal injury, death, property damage, or loss resulting therefrom.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

In consideration of being allowed to participate in Activities offered by the Releasees, I hereby agree:

TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against the Releasees, and TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense, or injury, including death, that I may suffer as a result of participating in the Activities, due to any cause whatsoever, including negligence, breach of contract, or breach of statutory or other duty of care, including any duty of care owed under applicable occupiers’ liability legislation on the part of the Releasees.
TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any damage to property, personal injury, or other loss to any third party resulting from my participation in the Activities.
THAT THIS RELEASE AGREEMENT shall be binding upon and effective for myself, my heirs, next of kin, executors, administrators, assigns, and representatives in the event of my death or incapacity.
THAT THIS RELEASE AGREEMENT shall be governed solely by the laws of the Province of Alberta and that any litigation involving the parties to this agreement shall be brought exclusively in Alberta and shall be within the exclusive jurisdiction of the Courts of Alberta.
THAT I AM NOT RELYING ON ANY ORAL OR WRITTEN REPRESENTATIONS or statements made by the Releasees with respect to the safety of the Activities other than what is contained in this agreement.

DIGITAL PRODUCT TERMS

All digital products, including downloadable training programs, meal plans, and virtual coaching materials, are final sale and non-refundable.
Digital products are licensed for individual, personal use only and may not be copied, distributed, resold, or otherwise shared in any format.
Access and delivery of digital content will be provided via email or download following purchase.
All digital content remains the intellectual property of Undisputed Boxing Gym and is protected by copyright law. Unauthorized use or reproduction is strictly prohibited.
Undisputed Boxing reserves the right to update, modify, or discontinue any digital product at its sole discretion without notice.

PRIVACY POLICY

Undisputed Boxing Gym is committed to protecting your personal information.

INFORMATION WE COLLECT
We may collect personal information such as your name, contact information, payment details, fitness history, and goals when you register, make a purchase, or contact us.

HOW WE USE YOUR INFORMATION

To process payments and manage your membership
To communicate class schedules, gym updates, and promotional offers
To improve our offerings based on your interactions and feedback

DATA SECURITY
We use secure platforms and encryption to protect your data and transactions.

THIRD-PARTY SERVICES
We may utilize reputable third-party service providers for processing payments, email communication, and data storage.

YOUR RIGHTS
You have the right to request access to, update, or delete your personal information at any time by contacting us.

CONFIRMATION

I CONFIRM THAT I HAVE READ AND UNDERSTOOD THIS RELEASE AGREEMENT, AND I AM AWARE THAT BY ACCEPTING IT (INCLUDING THROUGH PURCHASE OR PARTICIPATION), I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS, AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.

I AGREE THAT THIS RELEASE AGREEMENT SHALL APPLY TO ALL FUTURE PARTICIPATION IN ACTIVITIES WITH UNDISPUTED BOXING GYM UNLESS REVOKED IN WRITING.
